CanvasJS Chart End User License Agreement

This End-User License Agreement (EULA) is a legal Agreement between you (either an individual user, corporation or single entity) and Fenopix Technologies Private Limited (“Fenopix”), that covers your use of the “CanvasJS Chart” Software and all the other related components which may include associated media, printed materials, and “online” or electronic documentation. All such software and material are referred to herein as the “Software Product”. YOU AGREE TO BE BOUND BY THE TERMS OF THIS EULA BY INSTALLING, COPYING, OR USING THE SOFTWARE. IF YOU DO NOT AGREE, DO NOT INSTALL, COPY, OR USE THE SOFTWARE; IF THIS IS THE CASE, UNINSTALL THE SOFTWARE PRODUCT FROM YOUR SYSTEM IMMEDIATELY AND DESTROY ALL THE COPIES OF THE SOFTWARE PRODUCT AND ALL THE RELATED MATERIAL.

Copyright

This Software Product (including but not limited to any images, photographs, text, incorporated into the Software Product) is a property of Fenopix and is protected by copyright laws, international copyright treaties, and other intellectual property laws and treaties.

Grant of License:

Fenopix grants you the following rights provided that you comply with all terms and conditions of this EULA:

Trial License:

  1. License is per seat based and it allows one or more developers within your organization to test and evaluate the Software.
  2. You are not allowed to use trial version in production environment(s).
  3. Trial License will automatically expire thirty (30) days after the Software Product is first made available to you.
  4. By the end of the trial period, you need to get appropriate license or stop using by destroying all copies of the Software.

Developer License:

  1. License is per seat based and it allows one or more developers (depending on the number of licenses you buy) within your organization to install, use and develop software on top of CanvasJS Chart.
  2. You are allowed to develop any number of Web/SaaS, Mobile, OEM or Internal applications belonging to your company.
  3. You are allowed to distribute CanvasJS Chart Software along with your applications to the end-users.
  4. You are allowed to modify the source code of CanvasJS Chart.

Website License:

  1. CanvasJS Chart can be used within one simple public website that cannot be considered as a web application.
  2. Simple website is the one which does not have user login and does not show user specific data.
  3. Website License is tied to one single domain.
  4. CanvasJS Chart can be used by One Developer who works on that domain.
 

Licensing Model, Software Maintenance and Support

Annual Subscription

  1. You are allowed to use CanvasJS Chart as long as your subscription is active.
  2. Subscription can be renewed annually.
  3. You are entitled for all software updates & bug fixes while the subscription is active.

Perpetual

  1. You are entitled for all software updates & bug fixes for 1 Year.
  2. After 1 year, you can continue to use the last version of CanvasJS Chart that you received for as long as you want.
  3. After 1 year, you can optionally choose to get updates & bug fixes for 1 more year for a fee by contacting Fenopix.

Lifetime Updates: In case you have opted for perpetual license & paid for lifetime updates, you’ll receive updates for lifetime of the product, which is the period of time that Fenopix continues to support the software with updates and bug fixes.

Priority support is limited to CanvasJS Charting Library and will not cover any other technologies/products. You’ll receive initial response within 24 hours on working days & time to provide solutions/suggestions may vary based on the effort level involved. Hot-Fixes are charged separately on a case to case basis.

Fenopix may, at its own discretion, choose to discontinue support at any time by notifying the Licensee and refund partial support fees for the remaining support term.

 

Restrictions

Licensee may not transfer, rent, lease, lend, sell, copy, redistribute or sublicense the Software Product to any Third Party EXCEPT AS OUTLINED ABOVE.

Licensee may not distribute the Source Code of CanvasJS Chart Software with or without modifications.

Licensee may not redistribute the software or modifications as part of any product that can be described as a development toolkit or library that is intended to be used by a software developer and not an end-user.

UNDER NO CIRCUMSTANCES MAY THE SOFTWARE PRODUCT (SOURCE CODE OR THE COMPILED PRODUCT) BE USED IN ANY WAY THAT WOULD COMPETE WITH ANY PRODUCT from Fenopix

Termination

Licensee may terminate this Agreement at any time by destroying all copies of CanvasJS Chart Software. This Agreement will terminate immediately without notice from Fenopix if Licensee fail to comply with any provision of this Agreement. Upon Termination, Licensee must destroy all copies of CanvasJS Chart Software. Any such termination will not entitle Customer to a refund.

Disclaimer

NO WARRANTIES. FENOPIX EXPRESSLY DISCLAIMS ANY WARRANTY FOR THE SOFTWARE PRODUCT. OWNER OFFERS THE WORK AS-IS AND MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND CONCERNING THE WORK, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT, OR THE ABSENCE OF LATENT OR OTHER DEFECTS, ACCURACY, OR THE PRESENCE OR ABSENCE OF ERRORS, WHETHER OR NOT DISCOVERABLE.

Limitation on Liability

THIS LIMITATION OF LIABILITY IS TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. IN NO EVENT WILL THE OWNER (OR ITS THIRD PARTY SUPPLIERS AND LICENSORS) BE LIABLE TO YOU ON ANY LEGAL THEORY FOR ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES ARISING OUT OF THIS LICENSE OR THE USE OF THE WORK, EVEN IF OWNER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL THE OWNER’S LIABILITY EXCEED THE LICENSE FEE PAID, IF ANY.
